With regard to legal regulations, the Department of Public Benefit is responsible e.g. for:
preparing assumptions to draft acts of law and draft normative acts relating to the area of public benefit and volunteer work, operation of associations and foundations, and, in cooperation with the Independent Position for Social Economy, in the area of social economy, including social entrepreneurship and operation of social cooperatives;
preparing analyses and assessments of the currently effective legal solutions relating to public benefit and volunteer work, operation of associations and foundations and the entire third sector;
preparing legal and comparative analyses regarding the operation of non-governmental organisations, other entities carrying out public benefit and volunteer work;
preparing proposals of comments and opinions for draft normative acts of other divisions and departments of the Ministry, regarding the operation of the third sector, in order to consult those drafts;
analysing, in terms of the programme, documents of non-governmental organisations and public institutions in order to certify their compliance with legislation in force in the area of public benefit;
organising consultations with regard to the draft normative acts prepared by the Department;
providing answers and explanations of interpretative nature with regard to the regulations governing public benefit and volunteer work;
drafting assumptions of draft acts of law and draft normative acts, drafting positions of the Minister, preparing analyses and assessments relating to the compliance of legal regulations of the area of public benefit activity and volunteer work, operation of associations and foundations, and, in cooperation with the Independent Position for Social Economy, in the area of social economy, including social entrepreneurship and operation of social cooperatives, with the Community law;
conducting administrative proceedings, drafting directives and administrative decisions of the Minister of Labour and Social Policy, in particular with regard to the return of earmarked subsidies provided under the Operational Programme Civic Initiatives’ Fund, and considering applications for a reconsideration of cases relating to the issued decisions in order to draft decisions issued in the second instance;
preparing procedural letters in order to perform the supervisory functions of the Minister over the public benefit organisations, including requests by the Minister of Labour and Social Policy to the registry court to delete information about the status of the public benefit organisation by such public benefit organisation due to breach of the provisions of the Act on public benefit and volunteer work;
